1. Who we are
“Kathucoda”, “we”, “us”, and “our” refer to the operator of the Kathucoda platform and related music education services. “You” means the individual or organization using our services.
2. The services
We provide software and operational tools that may include:
- A public marketing website and informational pages.
- A mobile application for students, parents, or staff (as configured).
- An administrative portal for authorized school staff.
- Backend APIs, databases, email delivery, and integrations you enable (e.g. messaging or analytics providers).
Features may change over time. We may add, modify, or discontinue functionality where reasonably necessary for security, compliance, or operations.
3. Eligibility & accounts
You must provide accurate registration information. You are responsible for activity under your account and for keeping OTPs, sessions, and devices secure. If you believe your account is compromised, notify us promptly using the contact methods on our Contact page.
4. Acceptable use
You agree not to:
- Violate applicable law or infringe others’ rights.
- Attempt to gain unauthorized access to our systems, other users’ data, or staff-only areas.
- Introduce malware, overload infrastructure, or scrape our services in a way that harms availability.
- Use our services to harass, abuse, or send unlawful or harmful content.
- Misrepresent your identity or affiliation with Kathucoda.
We may suspend or terminate access for violations or risk to users or operations.
5. Lessons, scheduling & school policies
Enrolment, fees, cancellations, make-up lessons, and in-person rules are governed by the school’s separate policies and communications. These Terms apply to the software and digital services; they do not replace your enrolment agreement or local consumer rules where they apply.
6. Intellectual property
Our branding, website content, app UI, documentation, and proprietary software remain our property or our licensors’ property. We grant you a limited, non-exclusive, non-transferable right to use the services for their intended purpose. You may not copy, reverse engineer, or remove notices except as allowed by law.
7. Third-party services
We may link to or integrate WhatsApp, Instagram / Meta, hosting providers, email delivery, analytics, and similar services. Those providers have their own terms and privacy policies. Your use of third-party services is between you and that provider.
8. Disclaimers
Services are provided “as is” and “as available” to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation. Music instruction outcomes depend on many factors beyond software.
9. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the services. Our aggregate liability for claims relating to the services is limited to the greater of (a) the amounts you paid us specifically for the affected digital service in the three months before the claim, or (b) a nominal amount where no fees apply. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the minimum permitted.
10. Indemnity
You will defend and indemnify us and our staff against claims arising from your misuse of the services, your content, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.
11. Termination & account deletion
You may stop using the services at any time. You may request deletion of your account and associated personal data as described in our Privacy Policy and on our Contact page (account & data deletion). We may retain certain records where required for legal, accounting, or legitimate school operations.
12. Governing law & disputes
Unless mandatory local law requires otherwise, these Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India shall have exclusive jurisdiction subject to any non-waivable rights you have under consumer protection laws in your country.
13. Changes
We may update these Terms. We will post the new “Last updated” date at the top of this page and, where appropriate, provide notice in-app or by email. Continued use after changes constitutes acceptance of the updated Terms.
